Please read these Terms and Conditions prior to placing your order. By placing an order with Fruit Box you agree to the Terms and Conditions stated.
Any reference to Company/Seller/We/Us shall mean Gifts R Us Ltd. (Trading as Fruit Box) of Units 10 & 11, Hamilton Road Industrial Estate, Strathaven, Lanarkshire, ML10 6UB.
Any reference to You/Buyer/Purchaser shall mean the person detailed on the sales invoice.
We are committed to protecting your privacy. We only use the information we collect about you lawfully (in accordance with the Data Protection Act 1998).
These Terms and Conditions do not affect your statutory rights as a consumer. Transactions are governed by British Law and any dispute in transactions will be settled by British Law. |
| PAYMENT |
| We cannot dispatch goods until payment is received in full. Payment can be made by either credit/debit card, bank transfers or cheque. We accept most major Credit and Debit Cards including Visa, Visa Electron, MasterCard, Delta, Solo, Maestro, Amex and JCB. | SECURITY |
| All credit card numbers are encrypted in the software when the order is placed using 128 bit encryption. They are only decrypted after they reach our computer. They are not held in clear text on any web site. You can be assured that your payment is secure. Your card will be billed Gifts R Us Ltd. |
| DELIVERY |
All orders are only available to mainland UK destinations and are on a next working day service. Please note that although every attempt will be made to deliver goods on a requested date, we cannot be held liable for late delivery. We use external couriers City Link to care for and deliver your gift. We have found them to be amongst the best couriers in the market and have a very good working relationship with them, having been using them for over 4 years both in this business and in a sister company. The vast majority of orders will reach their destination on the day specified but occassionally deliveries are susceptible to conditions outwith our control. If your goods have not arrived on the day you have chosen then it is more than likely they will follow on the next day but please feel free to call customer services on 01357 524128 if you have any concerns.
Owing to the nature of courier deliveries we are unable to give a time of delivery. Drivers' schedules can change at any point during the day due to traffic or other circumstances out of their control. Courier delivery times are between 8am and 6pm.
We deliver all goods Monday to Friday and Saturday morning Orders must be received by 3pm in order to be delivered the next day. Orders for a Monday delivery must be placed by 3pm on the Friday of the previous week.
Most areas are on a next day delivery service. However please allow up to 2-3 days delivery time for the following postcodes:
HS2, HS3, HS4, HS5, HS6, HS7, HS8, HS9, IV41-51, IV55-56, KW16-17, PA61, PA62-75, PA76, PA78, PH42, PH43-44,
To ensure the order arrives correctly and on time we require the full Name and Address including postcode of the person you would like this gift sent to. We cannot take responsibility for any incorrect information supplied at the time of placing this.
Deliveries will be made through our courier City Link or Royal Mail. When delivery is attempted, if the recipient is not present, a card will be left stating an attempt was made. If it is possible to leave the goods safe or with a neighbour, this will be carried out by our Courier and a card will be left through the door stating where and when the order was delivered.
Once a delivery has been signed for at the address specified on the original order, Fruit-Box will no longer be responsible. Therefore no refund will not be given if the order does not pass onto the named recipient.
Our balloons are guaranteed to be of the highest quality. The average flying time for a helium filled foil balloon is 5-6 days, and in many cases longer. Customers should note balloons held in cold temperatures may cause the helium to deflate, however when placed back into a warm environment the helium rapidly expands again. |
| PUBLIC HOLIDAYS |
| Please note that there are no deliveries on public holidays. Orders received for delivery for these dates will be delivered the opening day before the date. For example, if the order is requested to be delivered on a bank holiday Friday when we are closed, we will deliver on Thursday. |
| ADDITIONAL EXTRAS AND SUBSTITUTIONS |
| Please note that on rare occasions we reserve the right to substitute your Fruit Basket/Balloon and or/gift with a similar choice if your first choice is out of stock. The substitution will always be to the same value or higher. Where possible Fruit-Box will always try to contact you beforehand. |
| REFUNDS |
| Refunds will only be issued for damaged goods or goods lost in transit. No refunds will be issued for late delivery. |
| RETURNS/COMPLAINTS |
Due to the perishable nature, Fruit-Box will not accept returns or any unwanted Balloons, Gift/Fruit Baskets. If defective, all packaging and contents of the box must be kept until a collection can be arranged for the return of the defective balloon/gift basket and subsequent inspection of it. Failure to follow these guidelines may result in the claim being rejected. When additional items have been sent the refund amount will only apply to the defective product.
In the unlikely event that you have a problem with your order, we aim to deal with complaints promptly and generally within 5 working days of receipt. |

| CANCELLATION RIGHTS |
A confirmation of your order will be sent via automated email to the address supplied on the order form. It will include your Order Number which must be quoted in all correspondence and a confirmation of the item(s) you have ordered and the total cost including all postage and packing.
If in the event you need to cancel your order, orders may be cancelled up to 2 days prior to the requested delivery date and a full refund will be issued within 30 days of cancellation.
If however the goods have been dispatched, by virtue of the Distance Selling Regulations Fruit-Box will be exempt from giving cancellation rights. |
